    Somebody with Nov05 PD tried to renew EAD and was given a 3 month EAD.......

    Use of "01" instead of "10" has been common mistake by USCIS. I came across couple of such cases. This is typo error and they will fix it.

    Don't see any light at the end of the tunnel...

    How much numbers can we seek..to recapture from the lost EB numbers from previous years? 500,000?? There will be a hue and cry...new headlines "half a million cheap labor" etc.

    Unless something like SKIL is passed only other thing that would help India EB2,3 would be to use these recaptured numbers to be used ONLY for priority dates older than 3years or something like that. Even if achieve legislation to recapture the EB numbers.. unlesss we seek something like this EB India will be screwed for ever.

    Read my message - I am *NOT* an IV member and nor did I represent myself as one - like many people I just subscribed to public portal - if you want to limit it to IV members, you must consider doing that .

    As far as talking in the meeting was considered, it was not an IV meeting and open to the public and I have all the right to say what I want to - whether it is inline with what you want to hear or not is not my problem.

    Tone yourself down before you point fingers elsewhere. GC is not your birth right.

    Its quite contradictory that you say that you are not an IV member and dont intend to be one, but you would like to particiapte freely and throw your opinion and get info about events with out aligning to the common goal of the organization. Now dont tell me that you got info about the event some where else. If every one of us try to get our own issue or a group of 15-20 people's issue solved we wont get any thing. This is common sense. What you said about making it paid site/open for certain members sounds bland to me. I am appalled that your thought process is not at all in sync with your accomplishments. If you think you can sell your group story and bring GC to the massess dream on. IV sure has lot of compelling stories that are sold already, but politics is bigger than you,me and our stories. If you are working only for people who are sought after by the stanford's and harvard's, move on.

    It's so unfortunate that we fight on issues like this. On your next conf call with Rajiv, bring up the same Q and seek his advice. Let us know what he thinks about your sales pitch and getting GC's only for the most sought. I am not mocking you or slinging mud at you. Its blatant that you are not understanding the political scenario. GC is not any one's birth right but that is what actuallly holding you up.

    I am sure they will ask for passport if you only have the I-94. Now if I am required to carry my passport all the time that becomes a real pain particularly if we are on H1/L1 and present for quite a long time.


    I 94 issued at POE must be attached to the passport all the times!

    You don't get it, do you? I've never talked about you. What I am saying is simply this: If you don't limit the number of immigrants from one country, you essentially become a part of that country with the influx of people coming from there. This is what people in America are afraid of. They can't limit the influx of illegal immigrants from Mexico and other latin america countries, and it is becoming a big deal for them, since they don't want to be forced to learn spanish next time they go to a diner.
    Is it racist? probably so. But remember, it is their country; They make the laws. They can make people dance for 5 minutes at ports of entry while they film it and post it to youtube if they like (see recent articles about search and seizures of returning greencard holders' electronic equipment).



    And who the hell are you to tell me this?


    What did I say? What I mentioned was the natural tendency of people of one language and one common background to gather together and stay together, even though the whole society asks them "Please forget your background and become one of us". How is that racist? This law stops the society to become divided into two factions of 'Us' vs. 'Irish' or 'Us' vs. 'Italians' or 'Us' vs. 'Iranians', etc. There have been several waves of people coming to US for whatever reasons; They are just making sure this doesn't happen again.

    This per country cap law is very much like the tax code. If you change it to favor one class of people, you end up screwing everyone else. The current immigration law favors me, so I am happy. It doesn't favor you, so you are (understandably) unhappy. Calling me racist and trying to chase me out of IV is not going to solve your problem.

    On one side you are praising the bigotry of 1940's and racism and on the other hand talking unity. I am sure you are are looser in your life and now Indians and Chinese are your targets since you don't know the meaning of competition. I am not going to waste my time as I am not even sure who planted you here. If you are really not a non-immigrant phony, please state your contribution to the IV efforts. Otherwise we don't need a racist punk like you. Now get off my back:mad:

    I think we should not care 'Is Murthy doing for her publicity / money?' as long as it serves our purpose. We should respect people who are trying to help us . and many folks are blaming she is money minded.... but u know what she runs law firm not non-profitable organization.
    In Iv many people are free riders when they can't contribute money to solve their problem why you guys expect Murthy to do charity work ....

    You will notice that there is not a single provision here that protects the rights of H1B workers and saves them from exploitation.

    There is not a single provision to punish employers who exploit H1Bs.

    Even with other immigration bills you will see there is not a single provision in these immigrtaion bills that punishes employers that hire illegal aliens. Thus all immigration laws being made never punish any US citizen breaking the law by employing an illegal alien or paying low salary or exploiting an H1B.

    Even with the current law, have you seen how many employers have been punished for employing illegal aliens. Do you know the penalty for getting caught. It is a mere $500 and nothing else. And you will be surprised to know that not even 100 employers have been fined last year. And only 2 H1B employers were punished after being sued by employees. No H1B employer was caught and punished for exploiting any employee. The laws are being made to favor US employers and to punish immigrants.

    I am surprised that nobody is noticing this.

    the laws are there , but only on the books, they don't fund them for enforcement.
    Also some laws are very week and needs to be changed.
    I think general american public is getting to know more about it as everyday
    passess with immigration debate. I think in the future if they pass any law
    it will come with heavy enforcement and also the provisions like hiking h1B and
    green card numbers, both will go hand in hand , there will be some controvercial provisions for both sides .

    In the new year, I have not seen any posts expalining how IV is "working" on resolving our issues. All that is posted now is requests for money. I know more money is needed and would be glad to contribute, if only the senior members show that some serious efforts are being made in the background. Yes IV did do very good work last year, but that is history now; but what work is going on now, nobody knows. Don't need details, but even broad details will help. Is something being done for appropriation bills, no one knows or tells.

    For example, after the elections no attempts virtually no attempts have been done to do webfax campaign tragetted towards pro-immigration inclined politicians. No lists have been made of such politicians. Just by waking up few days before the bills are discussed is not going to help.

    Persistence, patience, hard work, financial support, timing and combined efforts with one voice representing us will pay off! Lets all do our part. I feel I don't have skills to be in the front, taking initiatives, talking to people, volunteering my time. We must salute all that IV is doing, whatever little we can, we should support to make those efforts multiple folds. If we don't believe in the cause or the people, we fail. If you read a few threads closely you will find out, IV cannot publicly post all the efforts or progress being made, you cannot publish a game plan that everyone can read and groups working against IV can muscle in their amendments. I totally understand doubts when the going gets tough, but hangin there and all of us do our part, not just the money alone! IF you have the skills to volunteer and organize things, contact the core group too, everything they can get is valuable.

    The issue with not filing green card is ,even if it is written in offer letter..The lawyer can always come and say ' We tried our best to apply for your grene card. But we could not demonstrate that we could not find american citizens with minimum requirements.'
    A promise is a promise whether verbal or written.
    In this matter desi consultancies are far better.

    I know you are not going to like my reply...but written is a written issue. Desi consultancies and body shops have thier own issue. Infact they exploited the system and candidates to the core.
    Having things documented is the best way. If a company had to play fould it can do it anytime (even on verbal). I also learned the hard way. While writing we can still refere outside lawyers (of our choice)

    The draft letter looks good. I think, we should also send a copy or new letter to the Ombudsman and to the DOS (as DOS is also involved in how many visas are released).

    That way we do not get pushed around.

    Need help!!!

    I'm in US on L1 with company A, company B filed for H1B in Apr'09, H1 is not yet approved, and my L1 is also expiring in Nov'09. Since I'm not sure if I will get H1 approved, I have applied for L1 extension with company A.
    My question is:

    1. What will happen if I get H1 approved before Oct'09? Will I have to leave Company A and start working for compay B (H1) from 1st Oct even when L1 extension is in process?

    2. If L1 extension is approved before 1st Oct, will I be able to continue working for comapny A, even if my H1 is approved?

    Basically I don't want to be out of status or do anything against visa rules.
    Please guide me on this situation.

    IV is doing a great job.....I suggest to send email to the individuals private email about these conference calls and meeting etc in atleast 2-3 in advance, ....We get so busy that we may not be able to check IV daily, but we do check our inbox...Planning to go to the CT meeting tomorrow....Anyone from plainsboro send me a PM
