In past days, immigrants come to US thro only consular processing (no AOS in past) to become a permanent resident. Even now most of the immigrats (family based) comes thro CP. Therefore, one has to wait 5 years to become a citizen. This makes sense, because, this period is necessary to check the character of a person before becoming a citizen and to check whether one has maintained continuous residence here to become citizens. This same logic will not be good for people already in USA for more than 5 years legally (Particularly employment based immigrants). Only 10 to 15 % of immigrants go for AOS. Most of us here in USA for more than 5 to 10 years. We have waited for labor certification since 2001, waited for 140 and now waiting for 485. We paid taxes, maintained legal status and good characters during last 5 to 10 years. It is unjustifiable for us to wait again another 5 years to become a citizen. The old rule of 5 year waiting period makes no sense for people already lived legally more than 5 years here. In this current situation, one has to wait 10 to 15 years to become a citizen. It is a big wait. Therefore 5 year waiting rule must be eliminated for applying citizenship, if people maintaind 5 year legal residency (either in non-immigrant or immigrant or combained) prior to filing N-400.

Guys any update on Interim EAD. Did anyone even tried applying ofcourse thru infopass? Or is that every one are getting their EADs intime??

Due to the delays in obtaining EAD from Nebraska Service Center; I am planning to do the following things-
1. On the 78th. day (since currently NSC is taking 11 weeks= 77 days, to process EAD cards) call USCIS customer support 1-800 number and tell them that my case is outside the processing timeframe.
However, if I do this, my case gets locked up. That is any call the customer service representative takes and opens a service request; another service request cannot be opened earlier than 30 days.
2. Even still if my application is not approved, then I plan to walk into the USCIS office on the 91st day and request an interim card.
My question is since, I opened a Service Request on the 78th. day, can the local office representative open another service request to request an interim card on the 91st. day, since 30 days did not pass from opening my service request.
Gurus, please comment.
E-Filed on 04/15 . Wifes EAD Card received on 06/01. Mine still says initial review so Initiated a service request but looks like it would not have much impact as case is still under normal processing times.

Yes, do I-485 yourself, if you see your case is straightforward (not H1B transfer, ...). It is totall doable . We need an attorney for Lc. The I-485 form is much simpler, and, you are independent. Just download the form from USCIS website then follow the instructions. I regret of spending $2K for my attorney. I actually completed the form and they just send it. I recall to see one website they provide the service to check the filled legal forms.

You mentioned your RD is June 29th. Is it the date from your FEDEX tracking #? Or this date is mentioned on your USCIS 485 receipt? Why am I asking this as because, I sent my application on 30th July, USCIS got it on JULY 31st. I sent it to NSC, USCIS transferred to TSC, TSC issued my EAD, AP and a 485 notice on Sep 22 mentioning that they are transferring my case to NSC. That is why it is very important for me to know if they will consider my JULY 31st date or Sep 22nd?

What do I make out of this? U think once assigned to an officer thgs shud start moving? Or...even after getting assigned to an IO thgs can go bad? Has any thing of that sort also happened? Just curious so I can be prepared...

The lady was friendly and chked the status of my application. First she informed me that it was under review and then she told me that on Aug 3, it was assigned to an IO. I didn't ask any further questions as the news that my case has been assigned to an officer made me happy. I just wished her a good day and left.
Now, I'm beginning to wonder if I shud have asked more questions such as about Namecheck, FP etc...But I donno its with an IO and I guess I'll know the actual status shortly.

The amendment was on senate floor. It was passed (debated, voted) by senate.
I don�t know if this was just a tit for tat amendment (maybe sessions introduced a anti-immigration amendment and Kerry in retaliation introduced his amendment)
Also was this just something that Kerry threw out of his pocket. Or is this a precursor of things to come?

I just called today (this is the first time I called USCIS after filing my I-485). It was connected to NSC. The lady who took the call was very nice.
She told my case is pre adjudicated and my case is with an officer since today morning. And also said I should hear something pretty soon.
I really hope I (and all of you) get magic emails soon!

My child aged out on Aug 25th last year. MY labor was filed in 2001 and took 6 years to clear. My I-140 was approved in March 2007.

My wife attended the rally yesterday and this is what she wrote her friends who didn't come to the rally!
Yesterday, Shyam, Isha and I spent all day in DC as part of immigrationvoice, a grassroots non-profit organization that acts as an interface between highly skilled immigrants and the legislative and executive branches of the government. It was a wonderful experience. Over thousand people met at the foot of the Washington monument, and walked all the way to the US capitol. The organization had made good arrangements. Its amazing how people from all over the country were there and very few local people. One South African couple had driven on Monday from Indiana and came to the rally to celebrate the husband's birthday!! He wanted to be a part of this rally as a present for his birthday. We had 2 people - Manish and Sri, from New Hampshire staying with us on Monday who came just for the rally. There were some british, some chinese along with we Desis.
The need for the rally brought to light the real issues -
Most of us may have applied for our I-485 Step 3 in the greencard process, in July 2007, but that doesn't mean we will get our green cards soon. The govt accepts only 140000 applications a year and only 9000 are allocated to Indians in all categories.
Lawmakers and congress are confused when they think of immigrants - they club legal and illegal together. Even the Seattle senator who addressed the gathering yesterday made the same mistake. He said its good that you guys are out here so the congress can see its not only the janitors and others who have immigration issues but also highly skilled immigrants! No mention of legal. He used his time to promote the democratic party and we tried to remind him we don't have voting rights even though we pay the same taxes and work like everyone else!
We have to do something to be heard and heard right!
Thats the beauty of this country you can reach out to people in the highest positions and get heard. When the voice is collective its even more powerful. Shyam along with many others met with many congressmen and senators over the span on 2 days to explain our plight to them. One congresswoman mentioned that when a bill comes to vote in congress she polls the number of phone calls and emails she gets from her constituency and submits her votes accordingly. I was surprised to see how much actually our voice means.
We don't realize the power we possess since we are sitting in our own life bubbles of work, home, stress, kids and everything that most often swallows our individuality and ability to think. We need to step up think for ourselves and and help ourselves and everyone else in the process.
