You should call NVC and check with them the status of your application, most likely they have done all the processing for you. I doubt that they have a visa number for you, if they did they would have called you for an interview already.
We completed package 3 already last August and sent the forms together with ORIGINAL certificates to the NVC as requested. They also asked for the visa fees at that time which we also paid. So I guess we already have visa numbers ?
Our sponsor company in the US is waiting since almost 3 years for my husband to start working for him. I think we're lucky that he's willing to wait so long and didn't give up at some point during this whole process ?

Do not say that you want to see I-485 filling being applied to some bill.
I said the same thing and people came after me saying that I should stop asking about I-485 provision fate.
I never ever asked, I was just eager to see it as IV had mentioned.
I guess people have mis understood by words.
I beliebe that IV is pushing this provision. However, no sign of this provision indicates that there is no hope for any immigration reform in the near future.
Maybe it's really time for us to consider packing and going back home.

The first column showed the priority date. The second column showed the approved LC with the PD range but approved in FY 2006 and the third coulmn showed the number of LC with the same PD range but their Labor approved in FY 2007(as different application can approved in different times).
If we assume that all the applicants with PD before July 1, 2005 have been approved then remaining numbers are total of 11979 with PD before July 31, 2006 and after Jun 30, 2005. If we assume that all the applications with PD before March 1, 2006 will be approved within this FY i.e before 9/30/2008 then only 4707 numbers of applications with PD between March 1, 2006 to July 31, 2006 will be left.
Based on above data how could you assume that Cut-off Date will be back to 2004 and it will take 2/3 years to even cross the year 2005.
I guess it is not going to move any further.
There are more than enough applications waiting to be approved than the visa number available for ROW this year. It will move backwards to 2004 date in October when visa number for 2009 will be available.
Remember, PERM started in March of 2005, and there are floods of LCs with PD > March' 2005. It will take 2/3 years before it can move beyond 2005.

Yes, I did apply EAD renewal thru e-file on 4/26/2010. Rec'd FP for 5/20/2010.
I just went for a walk-in today(05/06/2010) and completed the FP(Code 2).
Waiting for the approval.

What did you enter in Current Immigration Status? Last time I went to India.. I entered on H-1.. then switched job on EAD.. hv never gone out and used AP.. what should I enter?
Is it mandatory to enter last EAD's receipt dates? My attorney filed it last time in 2008.. and I don't hv the receipt for that..

Here's a quick summary before the InfoPass recap:
EAD e-filed: May 27th
Receipt notices received: 1st week of June
FP done: June 19th
Card production ordered LUD: June 28th
Other soft LUDs: July 25th, July 27th
Still waiting...

Per the guy at the InfoPass counter, the FP report was received on July 24th (which probably explains the July 25th LUD). He said EAD will not be printed or sent out before FP check is complete. In 2007, they did not run FP checks to issue the first EAD after July fiasco.
So could this explain the delay that folks here are seeing? FP Code 2 was done for EAD, so not sure why this should take so long :mad: Maybe I am mistaken, but I thought that only FP Code 3 that's done for I-485 can take a long, long time. Can someone post info on EAD FP checks?
Update: Here's what I have after some quick research on USCIS biometrics:

This is electronically sent to FBI the same day, they run it to match thru their database to match it with criminals/persons of interest and send the results the same day (or the next) to USCIS. Code 1 is very important as it is part of your security/background check and determines admissibility for GC.
Code 2 (index+photo+sign) is for the generation of cards for immigration benefits e.g. EAD, gc etc. If you filed for EAD, you definitely need code 2 or the card can not be generated.
Code 1 expires after 15 months e.g. FBI needs to check their database again. Code 2 is done everytime we apply for benefits (EAD - once a year).
Code 3 is a combination of both, when USCIS wants to get a security check done on you as well as generate cards (EAD) for you.

I got mine in 8 weeks after submission. But For my son, it is six weeks and still counting...

so i am curious why did you wait that long knowing that EB3 train is a goods train w/o engine. You r pretty close now to your GC, however if 3 yrs back or so you had ported it to EB2, you wud had been greened way back.
At that time, I was working for a multi billion dollar company where over a million people are employed. The HR department was not ready to serve any individual cases. Moreover the job prospectus were not great there at that time. It was always on the limbo. In fact, I did process another EB2 case in 2006. I got the I-140 Approval on that after the first one. And my employer's Immigration Department did not agree for a switch even after I pleaded to them. It was really hard luck. I spent over 18000.00 dollars to get that EB2 one which went down the drain. What to do? Its just fate.

Today i got h-4 change of status approval notice for my wife from USCIS .
Her application for H-4 was done with my H-1 Petition.
Does that mean my H-1B has been approved too and i should be receiving that approval notice soon.
Also, What another document one receive with change of status. Do we receive new I-94 card too!!! if yes , we haven't received it , what does that mean?

Retrogression in Various Steps of the GC process
While January 2005 was the first time since July 2001 there was retrogression for the EB-3 category (01/01/02 for both China and India), the US continues to maintain protectionism through their immigration system.
Retrogression in Labor Certification: Between 2002 and 2005, there was severe retrogression as far as labor certifications were concerned. Then came the PERM in March 2005 and for a couple of years, they boasted labor certification with 3 to 6 months time. Of late I think it is taking more than 6 months for LC approvals even through PERM.
Retrogression in I-140 Approvals: I do not remember when the USCIS suspended the premium processing for I-140 but even before they did that, they managed protectionism by delaying the approval of I-140. As per some one's posting, it is now taking 14 months for an I-140 approval.
Retrogression of I-485 Approvals: Post July 2007 VB, even a 1st year engineering student from India, studying the American immigration system, can tell you it could take years (not the current 6-9 months processing time) for approval of I-485s. The delay in approving an I-485 petition is not subject to the the July 2007 Visa Bulletin alone, it cannot also escape 'protectionism-tainted' FBI name check delay.
I may sound like quite a pessimist, but add to all this the possible denials for PLC (permanent labor certification), I-140, EAD, AP & I-485s.

interestingly i have received RFE on EAD for Photos. and also received a biometrics appointment. however my AP is approved. they always surprise me. this is my 6th EAD, the surprises never seem to end.

he has applied for transfer to the old H1(2005 one for which stamping was no done)with i-94 attached
This is some what tricky. She was counted against the cap in 2005. So she should be good for next 6 years as it will be counted only once in 6 yrs against the cap. I am not sure if any employer can do a transfer based on the old H1B. I think the old H1B is no longer valid. She entered the country on H4 with a new I94. The old I94 is not valid. If the attorney knew all these. He could have filed change of status from H4 to H1 and exempt her from the cap as she was already counted against the cap in 2005. Hope it helps.

yes, thats what my lawyer says as well ... under section 245 k which applies to employment based GC applications, we can file follow-to-join within 180 days. In the mean time h4 status gets nulled and we should not travel out of the country.
I believe that as soon as you file under section 245k, your spouse will be eligible for EAD, AP.
Also, I have heard that 245k is straightforward and will be granted quickly- meaning your spouse will be granted gc in a couple months.
