Hi I am in process of filing 2nd PERM EB2 next month, my attroney says if the new position and job req is different then I should be fine(which is different than my previous Eb3 with 140 approved, Other Contries). But during my research I found some of the people are saying if 2nd PERM is file for Same employee , diff postion with same employer , it will hang at DOL for ever and I also found below posting only on Zhang & Associate:

About the PERM multiple filings, the DOL recently confirmed that if an employer has an APPROVED PERM application and files a second PERM for the same employee and a different occupation, the DOL will issue an audit requesting the return of the first application or an explanation of why there is a second application being filed and the first application can not be returned. The DOL is working on providing an FAQ which outlines acceptable situations where they will approve a subsequent PERM application.
The DOL also stated that if an employer has an APPROVED PERM application and files a second PERM for the same employee and the same occupation that the case will be auto denied. The DOL acknowledged that this poses a problem because there are valid reasons (e.g. change in worksite location) for filing a subsequent case and is working on this situation. In the meantime, the employer must either decide to withdraw the first case before filing the second case or file a motion to reconsider on the second case if it is denied explaining why it couldn�t withdraw the first case.

Alright guys, I cannot tell you how excited I am to report that i got a call this morning from my attorney and my online case status also states that Card Production was ordered for my case!!!
After 8 long years.....i finally have been approved for permanent residency. After 7 years, i will finally, with peace of mind, go back to India to visit my family. Thanks to IV, everyone's help on these forums for helping me keep my sanity over the past 2 years....
After 15 years in the US, I will finally have my green card in hand soon.

Yeah, if this is True, DOL Audit for new PERM for same Employee, then there is no benefit of filing new PERM! :mad:

Such a rush. almost all are opening SRs, infopasses, senator queries.then there is EAD delays queries and approvals. i guess USCIS IOs will go on few months vacation after this VB is done with. just hope that all you 05 and feb06 guys get through.

Yes Needhelp, just like EB3 to EB2 you can port from 5K to Half or Full Marathon but as Santb1975 said, only if the marathon and full marathon have not reached registration max of 18,000. They estimate this max will be reached by August this year.

The first step you should get your employer to do is to file a job order in the state job bank or americas job bank. You have to keep this ad for 30 days and then wait another 30 days to file PERM. This is the longest time. All other forms of recruitment needs to wait only 30 days and you can file PERM on the 31st day. There is no mention of working days or weekends, it is 30 continuous days. As you know in addition to this job bank order, and two Sunday newspaper ads, there has to be three other forms of recruitment before you can file PERM. If your employer and lawyer are really proactive it will only take 60 days to file PERM from start to finish. You also have to get a prevailing wage determination and post it at your job site for 10 days not including holidays and weekends. Hope this helps. Please contribute and incrase the membership of IV for the good of all of us.

one another suggestion I have to make is this:
We need to get Indian/Chinese community (citizens) involved to fight for us.
We need to have some of them as leaders in the IV. (they could be people who have struggled with the EB process and identify with us) they could be highly successful Indian/chinese or other countries businessmen/scientists/media personal etc etc (if possible)
Remember the strength of the ilegal community is that their legal brothers and sisters dont hate them but always stand with them.
We somehow ( I have no clue how) need to get this to happen. Also each one of us who are currently here should make a pledge that "Even if my card is printed, I will continue to use the extra freedom that I got to always stand up and fight for my brothers and sisters who are struggling with this system".

Yes He is correct. You have the full June to file.
No No i mean Does the date of June 1st 2003 mean that the Filer's PD has to be RIGIDLY On or before June 1st 2003 or can it be all of June 2003?
