    Hi,

    My 485 petition is with NSC. I opened an SR last month and got a rather uninformative response today. It does not tell me if my petition has been pre-approved or has even cleared the background check.

    gc chahiye.. both polls were excellent.. can you redo them and see if we can get a larger sample size?


    I wonder how many of the PD earlier than 2003, I-485 filed and 2004 PD, I-485 filed and 2005 PD, I-485 filed must have gotten gcs in the july fiasco.

    I am in same boat. Was your case transferred to EAC and then came back to TSC?

    I think its one time transfer to TSC.

    My son was born physically disabled (cerebral palsy). He his wheel-chaired bound and is totally dependent on us. He speaks and understands everything. He went to High School here,and got his Diploma and Certificates. That's why when me and my wife came here in 1992, from Bombay, India for my son's operation and came with B-2 visas medical visa. By the doctor letters our visa had continued for three and half years, and temporary work permit for two years only. Then we tried to change our status, but that didn't work out We also went to the INS local office, they advised us at that time it was better for us not to change our status. We did not get a deportation letter. We got a letter from INS saying that had they had CLOSE our case. We all three have SSN.
    My employer filed for LC in 01 and approved in 06. Also my brother filed for I130 in 01. In Feb 06 filed for I140 and approved in July 06. Due to backlog with the Labor Dept, my son is now 23. So my son can not file for I485 with me. He also can not file for PERM because he is disabled. Though he is very good at computers but who would hire a disabled person.

    PLEASE DO SOMETHING ABOUT THIS ISSUE!!!!!!!!!!

    Check your mail boxes folks!. I never got an email from USCIS but just found my green card in the mail box. An eventful day after all :)

    BharatPremi Please tell me I am wrong! i collected some data... and just by looking at it... it seems like EB3 will move very very slowly not as per your prediction! I m not a stats guru perhaps you or anyone who is a stats guru can shed some light here!

    What is your EB3-India PD (I-485 either pending, or not yet filed)

    50-50 between eb2 eb3 (assumption - probably a bad assumption)
    4410/year available for EB3?

    (This is where it really gets tricky!)
    ASSUMPTION -
    Approximate Indian EB3 Applications
    Total Indian applicants / 2 (50-50 between eb2 and eb3)
    Total 200k (low estimate) so EB3 100k approx
    + 100k Dependants = 200k Total EB3

    Year 2001/2002/2003 = 43.21% = 46286

    Number of years to clear off Backlog (2003 and prior) = 46286/4410 = 10 1/2 years

    Up until 1/5/2007 PD was stable at around 5/8/2001

    I think EB3 movement will be very slow based on above calculations

    EDIT: Even if Unused Visas get funneled down to EB3 India > cut the time in 1/2 still looks like 4-5 years to clear EB3 < 2003

    Does this sound right?

    The fact is that most of Pre 2004 EB2 lot is already out of the system. Those who are still in are sufferer of namecheck and BECs.There is no perfect mechanism to determine the ratio but I would guess 80% are out from that group. Second factor what we need to look is Most of EB3 Mid 2002 to Mid 2005 are still in the system. Third factor what we need to understand is that EB3 filing is always more than double of EB2. Fourth fact is that USCIS has to see "FIFO" is followed or not. So end effect would be we will see EB3 India progressing from this December till April 2008 bulletins reasonably. EB2 will be put on hold . End result in summary would be both EB2 and Eb3 will be brought to Middle of 2005 by next June bulletin. Once that happens Eb2-I will moving faster with comparision to EB3-I.

    I would say 90 % in the same boat :p No sweat. They will do an immunization test. You could even get the vaccinations taken
    But some of those vaccinations require a 90 days period don't they? ( Like Hep-B if I am right, may be not!!!) :confused:

    Hello IV:

    I happened to surf upon the NumbersUSA website and the general outlay of the website clearly establishes their objectives and motto. Although IV is fighting for a niche stage in the legal immigration process, a stage which almost all non-immigrants have to pass through, it is my perspective that this is never clearly communicated. The NumbersUSA website is visually more informative.


    Most probably, NumbersUSA has a much larger pool of money. Some persons believe in their cause by making contributions. They may have full-time employees and/or professional support.

    Most persons stuck in EB retrogression want service at NO COST. Most others want service at negligible cost.

    IV appears to be having a hard time getting contributions even they beg for it.

    Now a general question : for kids of 5 or 8 year old, the application should have their 'thumb print', right? It does say "thumb print of applicant or legal guardian", but I see no value in signing for them - there's no way to identify the child if I sign there... Or am I missing something why it's better for me to sign? (There's two places for signature/thumb-print : to sign for the application, and also at the 'specimen signature' spot).

    If they write thumb print then you can always provide it. Infact, it is there so that even the old people who cannot write can give their thumb print. So it won't hurt. Also, it looked to me that they are not too picky(like USCIS).

    While IV has not lobbied for any particular EB category but I think that is what they should be doing. Isn't one of IV's goals is to end retrogression ... so shouldn't EB3 be at least lobbied for since they are in such a mess ... I don't believe it sometimes that we are still in 2001.. that is 10 years back.

    In a couple of years EB2 will be more or less current. So that means a guy who came two years back will file in EB2 and get his GC and I who has been working here for 12 years would still be waiting in line.

    Some people say EB1 are brighter than EB2 and EB2 are brighter than EB3 . I find that funny because no one Eb1 or EB2 or EB3 is brighter than anyone unless someone has an extraordinary PHd or is a scientist . Its the lawyers who are brighter and how co-operative your company is.

    Besides when we filed in EB3 categories there was no retrogression and hence no one cared or else we also would have filed in Eb2 and got our GC.

    I think time has come for IV to lobby for help to EB3 people specifically since EB2 is almost done .

    I was in DC for the advocacy days, and as many of the attendees have written, there was not a single line that indicated of IV's preference for EB2. In fact, us members were told how futile the argument was - because no law is ever passed for one category alone. If the country cap elimination bill is passed (which IV heavily lobbying for) - EB2 and EB3 I benefit. If recapture bill is passed then too, EB2 and EB3 I will benefit. No law is ever made for one category. Sure, will EB2 benefit more? probably, because of the spillover rules. The lawmaker offices we went and met with, know less about the whole GC process. They know of retrogression - but do they know of EB2 and EB3 - not really. I would ask everyone who talks about EB2 and EB3 to actually go meet with their lawmakers office locally - and find out for themselves.

    Totally agree! I was appalled by some peoples suggestion to those still stuck in BEC to "enjoy the moment" on behalf of others and "not to be a spoilsport". It is really very unfair, but you know what, like arihant says, it'll be like, "See you at IV in September" (when the October VB comes out) to continue.

    Only difference is, you'd have "filed" 485 and if lucky you'd have gotten a receipt, because you might as well kiss your AP & EAD goodbye because there is no way they can process this ton load of apps any time soon.

    I hope USCIS finally sees the injustice that has be meted out to the all the folks - whether in BEC or not - and process the application in a FIFO basis.

    All those who are still waiting in BEC black hole, I feel for you. I was stuck in BEC for four years. Only managed to get out a couple of months ago after they allowed TR cases to be converted to RIR.

    I tend to think the same way as chanduv23. Our final goal is a Green card, and it may still turn out that the people who are currently still waiting in BEC may end up getting their GC in hand before many of the ones that can apply for 485 in July.

    The reason is that USCIS has clearly stated that it will retrogress big time in September. So, people with recent PDs may get to file their 485 but may have to wait for a long time for their PD to become current again to get the approval notice (folks, I am not wishing ill against any group here! I wish we all got our GCs ASAP. But since that is not going to happen, just trying to analyze facts). On the other hand, if BEC comes through with their sep 07 prediction, then these people with much older PDs may be able to apply for their 140/485 at that time and may end up getting their GC 6-12 months later because their PDs will still be current at the time of approval (Of course, this is assuming that they will not get caught in the Name Check Black hole)

    So, all those who are still stuck in BEC, please hang in there, your day of freedom will arrive (maybe sooner than you are currently thinking).

Nowadays, however, the Beltway is eeriely silent on immigration both at the level of legislation and at the level of government agencies. Obviously, this is a hot summer and vacation season. Besides, every issue is poised to the midterm national election. But this is somewhat unusual.
    * Under the circumstances, this web site considers any discussion of comprehensive immigration reform legislation pointless and we will cease our review and discussion on this issue on our site at least for awhile. We have thus removed the Q&A for S. 2611. We have decided that we would rather review some complicated immigration issues that most of immigrants face day in and day out regardless of the activities in the Beltway.
    * As for the ongoing policies and practices of the government agencies, we expect that the representatives from these agencies in the AILA National Conference in San Antonio will be able to supply to the thirsty mouth of immigrants drops of waters.     Received our approval notices in the mail today. Infact, our immigration attorney received them first. No emails, no SMS, no SRs. Online status still shows "Initial Review".

    Its been almost 10 years to the date. I wish all my friends on IV good luck and hang in there.

    Along the journey, IV has provided a lot of help & support and I will certainly be sticking around to help in whatever way I can.
