I am appalled at the insensitivity and selfishness of some of the posters here.

My labor certification (Traditional EB-3) is stuck in BEC since last 5 years. It is completely beyond my understanding why it took so long for BEC to process my case. Now everyone is rejoicing USCIS's decision to accept all green card applications, but I am paralyzed with the fear of facing another huge backlog on I-485 applications. One government agency sits on our applications for years and another government agency throws us further back in the line to cover up its blunders and guess what who pays the price: WE RULE-ABIDING, LINE-WAITING FOLKS.
Even if I get my labor approval before September, I will be among the last persons to get labor certification in spite of being the one with the earliest priority date. Nothing would give me greater pleasure than suing DOL BEC at this time. We may not sue DOL on their inability to clear the backlogs, but we can definitely sue them in their utter disregard to FIFO procedures (mind that some people with priority dates in 2004, 2005 have already got their labor certifications, but some with priority dates in 2001, 2002 are still stuck). When I read on their web site that they have tried to maintain FIFO, it makes me feel like puking.
I am also disappointed with IV's attitude towards the backlog victims. I do not remember anything concrete done by IV to address the grievances of backlog victims. Now that they have won the battle with USCIS, will they have time to look at us?

I would like to extend thanks to all of those who shared their thoughts on this labor certification backlog ordeal. I was touched with nice words some of you bestowed on my situation.
The point I was trying to make was that we high skilled immigrants continuously have suffered from the misdeeds of Congress and government agencies. It started in 2001 when Congress passed an amnesty when people in illegal immigration status were given chances for EB Green Cards. If government wanted to legalize them, shouldn�t Congress have created separate processing channel and also separate green card quotas for them? Why were we forced to share our share of green card quotas? Why did we have to undergo several years of grueling labor certification experience to make room for people who violated the immigration law?
Then there was a birth of so called �Backlog Elimination Center (BEC)�. This agency should have been rightfully named as �Backlog Creation Center.� BEC spent several years not in adjudicating the labor certification cases, but in transferring paperwork and performing a circus called �45 Day Letter.� When it finally started addressing the cases, it did with utter disregard to FIFO procedure. As of today, there are still thousands of cases stuck in BEC with priority dates of 2001 and 2002 (including mine). Though they have set the backlog elimination date to be September 2007, there are very strong chances that they won�t. I think life would have better for all of us if no BEC was created in the first place and the labor certification process was left the old way.
The purpose of my earlier post was to draw attention to the severe injustices BEC has thrust on us. The passion and energy IV showed in dealing with the recent USCIS fiasco was commendable. If IV can channel some of that passion and energy in dealing with the BEC problems, we may get some breathing space outside this black hole called BEC.

Good to see an EB3 thread with so many people in EB2 getting Greencards these days.
It is a matter of time EB2 I is current and nobody from EB2 will care for EB3. It is comforting that many IV core is EB3 and some good will happen to EB3. A friend of mine with EB3 I PD in 2008 has literally lost all hope of getting greencard and that is very sad. It is painful to see EB2 people not helping EB3 people. Why?

Chintu25 was talking abt reading patterns on a trade which are also known as Technical Analysis. For those who don't like to read books (that includes me too!!)...here is a link to a series of youtube vidoes that explains different patterns which in turn help you predict a trend (uptrend or downtrend) on a stock that you like.

I am in Atlanta, I would definitely like to do that. If we get more people to come join us (and some way to get some media attention - local FOX News or CNN). We could also try to bring our family to help us with the support:D
If you do so, local people will treat you the same way they treat illegal. after all the agitation and rally it created a negative sentiment for the illegal. So not a good idea. If we do somthing it should give result, not to create stir among public

I am jumping ahead of the situation here, but I just wanted to see what other members think/know. Assuming that the 90K visa recapture happens, It doesnt take too long for them to be used up in the current situation where there are a lot of people with labors and approved 140's (w/PERM). Not every one will have an oppurtunity to file for a new labor and file for 485. If DOS makes the PD's current / post Mar 2005, wouldn't it be unfair to people who labors are pending for 3 yrs. How does this work out in the previous recapture? HLG doesnt say about numbers being forwarded to the next year though.
HLG wants to give these 90 K to the healthcare professionals Schedule A only...So I donot know about you but I donot get anything for sure.....Even if the recapture is for all categories it would not make much difference....May be EB3 ROW would become current...and EB2 India dates would move a bit....

Yes after Logiclife gave an update I was not anymore excited about it and did not want to loose sleep over it. Thats because I trust IV. But its always good to clear the facts. Anyways, we should keep working for our goal and hope for some improvement in retrogression.

I hear contradicting news....hummmm.....
Indian media does not even know that for a proposal to become a law, it has to pass in both houses of congress and then go to conference and then go to both houses again before it goes to the President.
Last year, the Times of India said that Immigration bill passed even tho it has passed only in the Senate.
We have already reported that this amendment co-sponsored by Kerry and Kennedy went nowhere.
Apparently, Times of India group does not believe in doing research on Thomas.loc.gov about various bills.

If this kind of restriction is not done what will be best way to resolve H1b issue? If H1b increase is done and similar increase is not done on GC then also problem to all IV members(retrogession will continue). If there is cap then certainly it will be reached every year within April.
If they restrict consulting then Most of the H1b persons will get permanent job. Because of less number of H1 most of them will get gc within 2 or 3 years. GC holders and US citizens will do consulting. System will adjust iteself within a few months

Also, do you know that 70% of H1B are with Consultants who are fulfilling lot of companies needs on a daily basis. So, we can achieve something if we are united, if not nobody is going to get benefitted and all of us have to suffer.
We are not here to discuss on what is going to happen for future H1Bs applicants and divide legal immigrants into differnt groups, first we need to have some solution on what to do for the people already here and facing retrogression. So, we will stay united to show our problems.

eastindia, you are correct. GCPerm sometime back was on a "flower campaign" mode and was asking all IV members to send flowers so that USCIS will approve his/her green card ASAP. now that, it has been approved, the user has switched to a citizenship campaign mode.
GCPerm, a piece of advice. When a person volunteers for a cause to help others, the person should never think of how the result benefits them. If you look at IV members who are advocating for clearing this green card backlogs, by volunteering for the cause, they are not looking at how it benefits them, but how they can pave a way for future applicants.
When it comes to citizenship it is more difficult as I have personally seen people who are willing to continue with green cards for more than 20 years than taking up US Citizenship because they are more emotionally connected to their birth countries.
Anyway, note if you are sure of the fact that you want this campaign to continue even after six years of you starting it(by then you can become a US Citizen), then you should be promoting this.
Example, Aman Kapoor who started IV, got his green card and still fighting to clear the green card backlog mess.
Hope you understand the point. Nobody wants a leader who won't be able to continue once their ulterior motives are attained.

1) Fast-track GC process for Masters degree holders from US universities. This will be the least controversial, boost admissions (and money) flowing into universities, and clear up backlog in regular GC queue. Its a win-win and most senators, congressmen have voiced support for it already. We can get very good support from University lobbyists also (if they exist!!).

Guys, this is the time to show the core group that we are a bunch of people thankful that there is IV to help us fight this fight.
We need to stand united and raise awareness and sign up for the $20minimum a month recurring contribution.
I understand that some of you do intend to contribute and have contributed generously in the past,
But here are some mindsets, All of us fall in these 4 mindsets.
1) you probably think "why should I sign up for a monthly recurring contribution program". I am a generous contributor and I contribute almost monthly anyways.
2) I have contributed enough.
3) I will contribute if I feel like, when I see something comming out of this effort.
4) I do not have to contribute.
If you are in category 1).I can tell you, I understand because I have been a generous contributer in the past. But guys, the reason I signed up for a monthly recurring contribution is that it helps IV know that 'X' amount of funds are guaranted every month, this way they can better plan.
Category 2) Contributed enough - Okay why dont just sign up for a minimum amount of $20/month once more. What is enough is not enough.
Category 3) This has been discussed, I do not want to talk about this category of members.
Category 4) Again - No Comments-
Lets show the core team that all of us fall in the first 2 categories.
The last thing we want the core to do is bite their fingers over funds. We want do not want the core to get stressed out over funds. They have enough real work to do already.
Inspite of being a serious team player, and a generous contributor it took me two days to sign up for the recurring monthly contribution program, so I give all of the ones that have not set up a monthly recurring contribution benefit of doubt. But this is our last chance, I urge you to be one of the 2000 people we need for this effort. Need 898 members
