Kennedy's staff picked up something from their old files...like the original McCain-Kennedy bill of 2005 (the CIR before it hit the judiciary committee last year) that had the hard country cap and slapped it on Thomas against Session's amendment.
If you look at the text, its remarkably similar to the original McCain-Kennedy text (140K to 290K, hard country cap, recapture...all that. Even the description of the title).
They copy-pasted the text for skilled immigration from original McCain-Kennedy that was their brainchild, instead of copy-pasting it from S 2611 ES what had all the amendments from last year's senate CIR. But then again, copy-paste is very common on the Hill. Last year, Bill Frist copied the entire Judiciary Committee version and introduced it after deleting 2 titles related to Amnesty and guest-worker bill.
If this amendment had really passed, and if it had not been modified in the conference between house and senate and if hard cap had become a law, then this amendment would have done more harm than good.

My priroty date is August-2006 in EB-3. Last year i asked my employer to file in EB2 PERM petion and he has agreed for it. They applied my PERM application in August 1st 2010 in EB-2. I have been communicating the petition status with my attorney since my petion has been filed with DOL. When i contacted my attorney's office to check the petion status, they said my PERM applicant is in-processing status all the time. Finally, i requested my attorney saying write a wirtten letter to the Department of Labor in last week. He called me yesterday and said your application has been approved the DOL in August 2010. But his office never recived any hard copy or email. When they checked the PERM status, they never saw the petion was in approved status. Today when the checked the petition satus, they can see the application has been approved in Auguest and it is now exipired.
Please let me know what options i have.
Can i re-appeal with the DOL? I am not sure wherether my company has filed or not. Can i file a lawsuite on DOL or my current employeer?

No. Last year we had an RFE as my wife's medicals were missing a signature. As Pappu mentioned in another thread most of them were pre approved and were waiting on visa numbers I think.

I can relate with anurakt's feelings...it's amazing how penny wise pound foolish people can get!

I agree that house appreciates on average at inflation + 1% but it is still not a bad investment because most likely everyone would be taking a mortgage. So what we need to find out is a equity return on house?
For a 30 year mortgage and a 20% down payment, the house return on your invested equity of 20% by the end of 15 years is approximately equal to long term stock market return of 10%, even though the house is appreciating at inflation + 1%. This is because of deleveraging.
However, if we do not refinance by the end of 15 years then the house becomes a bad investment and the returns go down.

Plus the costs(maintenance and property taxes) related to house ownership makes it a really BAD investment. Imagine putting money in an account which gives 2% returns and has 2% maintenance charges!

The situation is the same. In my case and of course in most of others too, what he/she said is correct. Waiting for Eb3 to cross 2001 has become a difficult thing. If I started an EB2 app rather than hoping positively, I would have finished my wait for GC.

I am curious to know - if your hasband went to the consulate for the first time for VISA stamping or he had expired US VISA on his passport and a valid I-797 form and if he went for VISA restamping.
I will be travelling to my home country and will be going to US consulate for my H1B VISA stamping with approved I-797 next month. H1b VISA stamp on my passport has expired and I am here in the 8th year of H1B.

why would EB2 retrogress to before 2003? It was at 2003 for a long time (8 months?). The only people still with PD of EB2 2002 are the ones just getting out of BEC, there cant be too many of them...
There may be some EB2 Indians with PD in 2002 and 2003 (with traditional non-RIR LC) got out of BEC recently. If 1,500 Indian non-RIR LCs (with EB2 PD 2003)certified recently from BEC, that is sufficent to move the date back to 2003 for India again. Having said that, it is all prediction. No one knows, except USCIS. My prediction is just based on the magnitude of 485s (800K) filed recently, as is has all kind of composition in huge manitude, apart from so many 485s already pending due to name check.

You have to start all over if you find a EB2 qualified job and also if you qualify for that job,and your prospective employer couldn't find a qualified US Citizen or permanent resident for that job, you may port your current PD at the time of new I-140.

I sent in my OPT application on 26th of March, and it was delivered there on the 29th of March. I still haven't received a receipt and the check hasn't been cashed yet, even though it has been 4 weeks now.
Please do update me change of status. I am also facing problem with 29th March delivery.

CPO mail for my EAD application on 06/09/2010. it took total 3 weeks. wife's application status "Initial review"
Paper filed EAD renewal at TX USPS lockbox delivered on 5/13/2010. Check cashed 5/19/2010. received receipt on 5/24/2010. soft LUD on 5/25/2010, current status - "Initial review"

Before we ask Congresswoman Zoe Lofgren for any further help/support, don't you guys think it will be appropriate to first thank her in some kind of noble way? Any ideas?
I personally think (at least to begin with) a letter expressing gratitude for and our faith in her efforts would be a nice gesture.:)
Do we know for sure that this letter is in fact real? I mean yes it's on one website that has a link to a PDF document, but surely we can get it verified from another source (and I don't mean another immigration website forum) before we start sending her thanks and flowers.
