hi,
I've got my L1A visa valid till MARCH 2010 with company A. Meanwhile my H1B VISA got approved thru company B for this year.i would like to continue in my L1(company A) for few months until i find a suitable project with the employer who processed my H1(company B).
how long can I continue in my L1 status
a)if it is a fresh H1B ?
b)if the H1 is a "change of status"?
c)what can i do if i need to retain L1A VISA status for the period after the Change of Status happens ?
pls help.

I had a very good experience with him..his charges are reasonable...I don't know his contact info off the back, but you can google up the words Virendra, Goswami and Immigration, and should be able to pull up his contact info...

I had the same issue. Because in my passport surname was missing ( not missing but it was added at the end of my first name) that triggered an FNU in H1 visa.
But in my h1 petition it came out ok. and in I-94 i wrote my name correctly. so that was not an issue. and DL and SSN it came out OK based on I-94.
i corrected it in my passport first. then during H1 visa renewal it got corrected automatically.
even though you have FNU in visa, mention your name correctly in your I-94. otherwise every official document(SSN, DL etc.,) will have FNU as your first name. My friend suffered a lot
because of this issue and he had to go back to india and come back with right I-94 and corrected the rest of the documents later.

My friend will come from India on H1B first time to Atlanta Air port this weekend. His H1B was approved for year 2008 and his stamping was done in early 2009. His H1B is from small desi consulting company. What kind of questions he may face? Any inputs will highly appreciated.
The IO at the border post may ask similar questions that he may have faced (or he may have prepared for) when he went for the visa interview at the consulate...

here are the visa numbers used in 2006 for EB2 and EB3.
EB-2: India(3,720), China(3,347), Canada(1,248)
EB-3 Skilled: Mexico(6,766), Korea(4,375), Philippines(4,114), Ecuador(3,747), Brazil(3,670), Poland(3,230), India(3,006), China(2,477), Pakistan(2,091)
Assuming there are atleast 300K Indians waiting for visa numbers in the EB2 + EB3 category (including dependents) and 6726 out of them were covered last year, we will have to wait for just another 44 years and 7 months to get an immigrant visa number. LOL

hi,
i have a question whether to use EAD or H1B? Initiallly i re-entered into usa after finishing my first 6yr term of H1B in June 05 on H1b. Later changed employer. New employer filed my GC using existing labor (EB3) in 2006 and also filed for i-140 & i-485 in oct 2007. so the transferred h1b is expiring on 06/2009. my ead expired in Oct 2008. I am thinking of renewing EAD than H1b which i am planning to file in this month (Feb, 2009).
questions:
1. If i go back to India in Mar 09 - Can I come back using EAD (Once its approved and someone sends my EAD & AP to India) as i haven't used EAD?
2. my transfered H1b is expiring on Jun 09 and i don't want to go to Madras to stamp the transfered company's visa on my passport as i doubt to get it - the Consulate might ask me so many questions when its expiring in june why you want to go to usa for 3 or 4 months.
3. The best bet - do i need to wait for my renewal of EAD & AP and then leave?
Please let me know as my travel plans are dependent on this.

I always belive Premium is better and this is just a rumour that it attracts RFE.
The reason is plain and simple, let's say that you change to Company B and since normal processing takes anywhere from 3-6 months (let's say in meantime your old employer cancells your H1B) and at end of say 3-6 months you come to know that your H1B transfer to company B is denied you have no option but to leave country.
Whereas in permium in 15 days you will know if that is through or not and GOD forbidden even if that gets rejected , you still have paystubs which will be just 15 days old, still you can do another H1B transfer with a new employer.

you can work in your field of education for any company. however, they have to file for a transfer of H1 for you to continue working beyond the expiry of OPT.

The H-2B program is critically important for many businesses that have difficulty finding U.S. workers to fill temporary jobs. This is particularly true in seasonal industries. Comments from H-2B employers attest to the need for foreign workers in physically demanding seasonal jobs, often in remote locations, that many U.S. workers will not take.
The H-2B nonimmigrant visa (http://www.h1b.biz/lawyer-attorney-1137785.html) program permits employers to hire foreign workers to come to the U.S. and perform temporary nonagricultural work, which may be one-time, seasonal, peak load or intermittent and there are no qualified and willing U.S. workers available for the job. In order to learn more about employers� perceptions of the H-2B program, ImmigrationWorks USA and the U.S. Chamber of Commerce conducted a survey: five short questions distributed among H-2B employers in July and August 2010. The survey asked how many H-2B workers the company had hired in the last three years and what types of jobs those workers held. It included two open-ended questions about the benefits of using the program and asked what if any problems employers had experienced.
Another open-ended question asked what employers would do if they were not able to hire H-2B workers. Participation was voluntary, and results could be submitted via email, fax or the internet. A total of 367 employers responded. The majority of H-2B employers who responded to the survey noted that temporary foreign workers are reliable and hard-working. Many also praised these workers� productivity: a benefit that offsets the cost of bringing them into the United States. Respondents appreciated that H-2B workers were willing to work seasonal jobs and then return home when the season ended.
Important benefit of the program is that it offers companies a way to hire foreign workers when U.S. labor markets tighten. The program increases labor market flexibility by allowing businesses to bring in foreign workers when U.S. workers move up to better, higher-paying jobs during economic expansions.

At last my labor is approved and I was to planning to file my 140 under PP. How ever, I am reconsidering the thought as my wife is on H4 and she is being hired on a H1B from Oct1st. If my 140 is filed under PP and approved, her H1 is approved by June/July Can I transfer my H1 to another company to port my PD? What happens to my wife's H4? I am under the impression that she needs to file an extension as well along with me. This will have her H4 approved after H1 and she will need to re validate her H1 status by going out of the country.
Is it possible that my new employer request my H1 transfer and we chose not to request my wife's extension along with mine if she has 2+ years left from the extension we received based on my previous extension? If we have to file for her extension when I transfer (which I think) PP is of no use as Oct 1st 07 is 6+ months away.

I have done this successfully twice (extended) , but you do have to fill out that column. Its a big risk to give incorrect info, since they will find out with A#.

i think it is based on the LC requirements. For EB2, u need " A petition for a foreign professional holding an advanced degree may be filed when the job requires an advanced degree (beyond the baccalaureate) and the alien possesses such a degree or the equivalent. The petition must include documentation, such as an official academic record showing that the alien has a U.S. advanced degree or a foreign equivalent degree, or an official academic record showing that the alien has a U.S. baccalaureate degree or a foreign equivalent degree and letters from current or former employers showing that the alien has at least 5 years of progressive post-baccalaureate experience in the specialty."

I am in Austin, I got my FP done on 10/11 in San Antonio. It was a pleasant experience if you go early. My applicatoin was reached NSC on 2nd July. Got EAD, but no AP yet.
