hellomms Could you gather all such people who are facing this issue and want to join the effort to fix it, at a single place on an IV thread. Once we have a sizable number of people to take initiative this effort can be successful. It is difficult to divert attention and resources for a single person. Each immigration issue that our community faces is important to the person suffering from it. IV is a place where people can get together and do something about fixing it.

Now EB2 is also stucked at2003 Jan.
It took 11 months to move 8 days. When Eb3 get into retrogressionevery one started filing in EB2. I think if nothing comes relief like SKIL \ CIR better to stay wit EB3 - Mar 2004.
I think with in one year EB2 and EB3 wil get same priority dates.

Seeing the way the health care bill is going, none of the EB3 folks are seeing any hope for CIR.
I also do not have hopes on CIR. We really are in hopeless situation.

Convince your employer and file 485 as soon as possible. With the huge volume of the applications who knows what will happen, they might move the date back again.

Hi,
I applied for H1 and H4 for my Family in 2005. I was working on L visa that time. Our H1 and h4 got approved in October 2005 but we were in India that time. We came to US again on L Visa in 2006.
After coming on L visa my new employer applied for my H1 change of status again in 2006 but not for family. Their H4 from 2005 was valid till 2008.
But Now while I am changing my job, New attorney says that my family is out of status and because we did not file H4 for them again.
What is the alternative to bring them in status. They have vaild i-94 from L2 which is valid till 2009 and they have approved h4 from 2005 which is valid till 2008.
Now my new employer have started my H1 transfer. I am thinking that for my family I will apply H4 change of status once my approval comes. Is that Okay or there is any other alternative to bring them in the status.
My family can not travel to India for H4 stamping till the end of this year. My wife will be delivering a baby in October. Will there be any problem for my new born baby for the passport?
Please advise.

A 2002 PD would get GC earlier that 2006 PD, even though the 2006 PD may get EAD/AP and other benefits earlier. EAD and AP have nothing to do with PD, only I-485 depends on PD.
Have you got this info from a truely realiable source? It seems there are 2 different opinions about this process, that's why I'm asking. I think it's fair to go by PD, but how CIS could sort out earlier PD from tens of thousands of applications is another question.

Can i file it myself ? i did talk to a lawyer and she said we need a document from a company saying that the position is still open before we can file I485 by myself.

Unfortunately your lawyer is correct. You can't file 485 (even if you have copies of labor certification or I-140) on your own without a letter from your current employer explicitly stating that the position posted in labor certification will be open at the time when you get your green card.

good point ..I do invest in stocks / ETF's and funds ...but I would definitely say ..stay away from day trading !!! be diversified, invest in good companies (invest only pocket money/minor amount in very risky assets) and for the long term ..i.e. you should not need that money during emergencies ..STAY AWAY from all day trading software !!! and if you cannot take losses (or are happy with normal returns) ...stay away from stocks (except for a small portfolio/ 401 etc) completely

Depends on lot of factors. I have been trading for last 10 years. I don't trade stocks. I trade index futures sp500 and Nasdaq mini. It is short term - couple of hours to maximum couple of days. Day Trading requires good analytical skills for technical charts and lot of discipline to follow enter and exit rules.
Taxes are computed differently for futures trading. You will need this IRS form (6781 Gains and Losses From Section 1256 Contracts and Straddles) to file your taxes for trading futures.

I agree. They are mostly snake oil. I suggest - do some reading and follow some indicators and come up with Trading Strategy. It is recommended to do paper trading before starting trading with real money.

Trading, of course, involves risks. I pick funds for my 401(k). So far it has been good. I was up last year 4.2%. Never had any losing year in 401(k).
There are many tools for technical charting. I use Ninja Trader since it allow to me define new indicators using c# (.net) language.
If anyone is interested, I put my daily charts here. Sorry, I can not disclose my indicators and I don't have anything to sell either.
I can share some trading books, if you are interested.

Can you talk a bit about ROW EB3. Do you think with PD MAY 2004, with EAD, AP on hand, should I try a new EB2 or stick with the old one?
I don't see any problems for ROW - i think your strategy should be wait and watch (at least for the next 6 months)

You can move but are you changing employment? If yes, AC21 kicks in only after 180 days after filing 485, assuming 140 is approved.
2. We do have a PO address is Texas now and have an apartment in CA for next 5 months.
Do you recommend to use the Texas PO Box address instead of California Apartment address for USCIS I-485 application such that we can avoid the Change of Address with USCIS later?

I think that we need to point out to law makers that employment based petitioners are being differentiated from citizens . Whlie in their case the date of child is frozen on the date of the I-130 application, why not same treatment should be given for I-140.
I again hope our Core Team members will take up this issue.
This would still eliminate many of the children who have already aged out. Their dilemma was due to labor backlogs. Since labor certification is an integral stage in the employment based green card process the initial priority date should be the point at which their age is frozen. As per pending list of Emploment based I485 published by USCIS , and per my my estimation, EB3 with PD up to Dec 2004 will be cleared on or before Sep 2010.
Further if EB4 , EB5 , and EB6 spill over is allowed , then up to PD Sep 2005 (EB3 ) will be cleared by end of Sep 2010.
I wish this was true, good to see your optimism. I am not trying to shoot you down, but all the numbers published and crunching says otherwise.

E-filed EAD on 24th April.
Supporting documents received on Apr 28th.
Received EAD receipt on April 30.
Last year I remember receing the receipt and biometric appt letter together.
Has anyone who efiled for EAD renewal this year have received biometrics appointment?
Please let me know.

I efiled ead petitions for both myselft an my wife on April 19th. I received the approval and the card on May 1st for my petition. I did not receive any biometric appointment. I have done efiling last time too.
however my wife did not get her approval yet although both of them were filed on the same day. had some luds and then no updates since april 27th.
