Despite the offensive posts and badmouthing on IV site and other sites we are keeping everyone in mind when working on our lobbying effort. We had posted messages in the past about this too. IV does not advice any flower campaign etc without consulting with us. Any wrong move can potentially hurt the interest of this community and the advocacy work we are doing. Please stop posting offensive messages and stop fighting with other members of the community.

Years we have been told priority date establishes your place in the queue.
We have spurned job offers and declined the new PERM process to hold on to the priority dates.
Many are still awaiting labor certifications from the backlog elimination centers. Out comes USCIS and says everyone with a LC can file I140 & I485.
People still waiting for LC with priority dates in 2003-2004 are seeing applicants who have priority dates as late as 2007 but with approved LCs through PERM walk through to I485.
Net result, USCIS is going to be flooded with applicants enough to retrogress the priority dates 3-4 years back as early as september. (Everybody with a LC will be able to file for I485 in July). So applicants with priority dates of 2007 are going to get EAD and GC, while LC backlogged 2003 applicants to have to wait for another 3-4 years before they can even file I485.
Aint fair. Aint fair at all. How can this be. How can rules be changed in the middle of the game.

Hi Folks,
My PD is current but my lawyer is saying that I CANNOT file I-485.
Reason:
My labor cert / EB2 was originated in Illinois and then amended for Virginia by G-28.
Since my labor cert approval, i moved to Califonia - same job, same company.
Now my lawyer is saying that I need to go back to Virginia so i can apply for I-485.
Question:
1. Do i have to go back to the same state/location at I-485 filing stage where my Labor was originally approved?
2. Doesnot Green Card is for a future job?
3. Can i file I-485 while I am in California and my labor was approved for VA?

LC stuck in DBEC......I submitted my final documents end of May and hoping to get my LC certified end of this month (fingers crossed).

Me and my wife were called for interview at Newark, NJ office after we got the Notice for case transfer in Oct. 2009.
I think the notices we received at home did mention the Newark, NJ office, don't remember for sure.
I have an INFOPASS appointment this friday, 27th May to find out why is it taking time for my case to be approved.
Hopefully, there will be no problem with my case.

One can have a Perm labor and a BEC approved labor. I know people who have both the labos with them each from PERM and BEC. and each case PERM was approved before BEC

Visa numbers WERE available July 2nd!!
We have confirmed with a knowledgeable official in the Department of State Visa Office that USCIS was requesting visa numbers on Sunday July 1st, and Monday morning July 2nd - and that visa numbers were still being issued as late as the morning of July 2nd!
In fact, close to 30,000 visa numbers were requested and issued in July - through the morning of July 2nd. And we believe that many - if not most - of the requests made in the first two days of July were for applicants whose priority dates were not current in June!
So how can USCIS refuse to accept I-485 filings received BEFORE the State Department issued its notice that all visa numbers had been used???? We have not yet confirmed the return of any I-485s filed in July. But we do know that applications were reaching the USCIS before the State Department announcement - and while the USCIS was frantically working to use up the entire year's allocation.

Historically, the USCIS doesn't request a visa number from the Department of State until it is ready to grant the adjustment of status application. US Consuls overseas request visa numbers the month before they intend to issue the immigrant visa. The three events we will be walking/running as a Team are about getting our organization's name out in the open. This can help increase membership and further financial support for IV. By getting our name out there, we are sure to encounter more legal immigrants who may not be aware of IV as a resource. Thus introducing them to IV and providing them with a support network for their future immigration issues.
I have introduced this concept to several of my friends all of whom are US Citizens and each of them support legal immigrants who are here in the US working honest, legal jobs. Each of them have already promised that they will join Team IV and support the fundraising of $300 per Individual Member to support IV's longterm lobbying efforts.
IV has had some very significant successes over the past year and your continued support via Team IV can help with IV's long term goals.
I hope you will join us in this campaign!:)

we sent EAD renewal application thru attorney on March 16th 2010, it was delivered but didn't receive any update/ USCIS didn't withdraw the fee also till now...lot of delay it seems this year.

Did you choose the option 'your case is outside of the processing time'? Call them again and tell them it is delayed. SR (probably) was the key in my case.
Congrats Masterji. BTW, how were you able to open the SR. I called them this morning and they told me that my PD became current yesterday so I should wait for 30 days before calling them back.

Called the customer care today. The representative opened a SR as I haven't received biometric appointment notice. Not sure how that's going to help as many folks have got their EAD without fingerprinting.
EAD expires on 92nd day. So keeping the fingers crossed :(
I woudn't worry much, it's not been even 2 months. My wife's EAD filed in mid-march was approved in 60 days. next week we both recvd notices for FP. i sent my EAD and our AP's 2 days before our FP appointment date. i think you will recv yours by month-end. Good luck.

I have mixed opinion about that. Say, hypothetically she attends rally, then everyone is going to think that she is biased towards legal immigrants.
It would be better if people looks at her as a non biased person, her word is more powerful that way.
Its just my opinion.
Please inform her about the rally in San Jose on Saturday. It would be great if we can get her support !

The three days were packed with drama - Like any good drama, this too had it's moments of tension, action, and humor....the funniest one was:
Right before the rally when Aman was EXTREMELY busy, he actually had 30 seconds for each reporter. Our sweet little Jane walks up to him and asks "Aman where are my clothes?"
Aman had the funniest expression on his face :confused:
Here is the background : All of us had stayed in the same hotel and at the check out time we had kept out luggage in the baggage room. Aman had the tags of Jane's bags and Jane thought that Aman would get her luggage @ the rally!
Guys u had to be there - It was hilarious:D:D:D:D

hahaha, I remmeber on Monday night while getting out of Situation room, Aman figured that two of his bags were missing and he was trying to figure out where they are. He only had his laptop bag with him. When I drove in to pick up 3 guys at the hotel, the guy who was with Aman (I forgot his name) thought I am picking up Aman and started putting Aman's laptop bag in trunk of my car. Aman saw it at the right moment and took that bag out of trunk and probably thought no wonder why his two other bags were missing.
I think he eventually found those bags, people taking care of thos ebags took them for ride and dinner.

It is so sad that H1Bs are exploited by those "consulting" companies (which essentially are "human trafficing companies" like doing "slave trade") while Americans (at least some Americans) hate H1Bs. We are like modern "slaves" that nobody cares about. :rolleyes:
